1. General Provisions & Business Information

  • This website is operated by Lovely Malice based in Sheffield, United Kingdom.

  • Throughout the site, the terms "we", "us", and "our" refer to Lovely Malice.

  • We reserve the right to update or amend these Terms & Conditions at any time. Your continued use of the website following any changes constitutes acceptance of those changes.

2. Custom & 1-of-1 Finished Goods

  • Bespoke Nature: Every item listed on Lovely Malice is 1-of-1 and custom-finished. Due to individual finishing processes, minor variations in texture, finish, or distress details are intentional characteristics of the garments, not defects.

  • No Exchanges or Change-of-Mind Returns: Because all pieces are custom-finished and one-of-a-kind, we do not accept exchanges, returns, or cancellations for change of mind, ordering errors, or incorrect size selection.

  • Sizing Accuracy: Replacement sizes do not exist for 1-of-1 garments. It is the customer's sole responsibility to thoroughly check the Size Guide and measurement tables provided on each product listing before placing an order.

3. Orders, Pricing & Payments

  • Order Acceptance: Placing an order does not constitute a legal contract until we confirm shipment. We reserve the right to refuse or cancel any order for reasons including, but not limited to, item availability, errors in pricing/product descriptions, or suspected fraudulent transactions.

  • Pricing & Currency: All prices are displayed in GBP (£) unless auto-converted by your browser location. Prices exclude shipping charges, which are calculated at checkout.

  • Payment Processing: Payment must be made in full at the time of purchase via our integrated secure payment providers (e.g., Shopify Payments, Stripe, PayPal, Klarna).

4. Shipping, Delivery & Customs

  • Dispatch Times: As garments are custom-finished, dispatch times may vary depending on drop volume or finishing requirements. Standard delivery timelines provided at checkout are estimates and not guaranteed.

  • Shipping Addresses: Customers are responsible for entering complete and correct shipping information. Lovely Malice is not liable for packages delayed, lost, or misdelivered due to incorrect addresses provided by the customer.

  • International Orders & Import Taxes: For orders shipped outside the United Kingdom, customers are considered the importer of record. You are solely responsible for any import duties, taxes, or clearance fees levied by your local customs authorities.

5. Faulty Goods & Consumer Rights

  • Nothing in these terms excludes or limits your statutory rights under the UK Consumer Rights Act 2015 or Consumer Contracts Regulations 2013.

  • If an item arrives damaged in transit or significantly faulty, you must notify us within 14 days of receipt at hello.lovelymalice@gmail.com with photos of the issue and your order number.

  • Confirmed faulty items will be assessed for repair, partial refund, or full refund in accordance with UK law.

6. Intellectual Property Rights

  • All original artwork, custom designs, website text, logos, photographs, graphics, and brand assets are the exclusive intellectual property of Lovely Malice.

  • You may not reproduce, duplicate, copy, sell, or exploit any portion of our products or brand materials without prior written authorization from us.

7. Prohibited Uses & Website Conduct

In addition to other prohibitions outlined in these terms, you are prohibited from using the site or its content:

  • For any unlawful purpose or to solicit others to perform or participate in any unlawful acts.

  • To infringe upon or violate our intellectual property rights or the rights of others.

  • To submit false, misleading, or deceptive information during checkout or customer inquiries.

  • To upload or transmit viruses, malicious code, or scrape site data.

8. Limitation of Liability

  • To the fullest extent permitted by UK law, Lovely Malice shall not be liable for any indirect, incidental, or consequential damages resulting from the use or inability to use our products or website.

  • Our maximum cumulative liability for any claim arising out of an order shall not exceed the total price paid by the customer for that order.
